Bunyan Bags Brand Ambassador Agreement
This Brand Ambassador Agreement (“Agreement”) is entered into by and between Bunyan Bags (“Company”) and the individual applying or accepting participation (“Ambassador”).
By participating in the Bunyan Bags Brand Ambassador Program, you agree to the following terms:
1. Program Overview
The Ambassador agrees to promote Bunyan Bags products through personal channels, including but not limited to social media, blogs, and other platforms, in exchange for commission-based compensation.
2. Commission Structure
- Ambassadors will receive a 10% commission on all qualifying purchases made through their unique referral link or discount code.
- Commissions are calculated based on the final purchase amount (excluding taxes, shipping, and returns).
- Bunyan Bags reserves the right to modify commission rates with notice.
3. Payment Terms
- Commissions will be paid on a monthly basis (or as otherwise determined by Bunyan Bags).
- A minimum payout threshold may apply (e.g., $50).
- Payments will be issued via a method determined by Bunyan Bags (e.g., PayPal, bank transfer).
- Returned or refunded orders will not qualify for commission.
4. Ambassador Responsibilities
The Ambassador agrees to:
- Provide all social media links for verification and review
- Promote Bunyan Bags in an honest, authentic, and professional manner
- Accurately represent the products and brand
- Comply with all applicable laws and guidelines, including FTC disclosure requirements (e.g., clearly disclosing affiliate relationships)
- Avoid misleading, false, or exaggerated claims
5. Content & Usage Rights
- The Ambassador grants Bunyan Bags a non-exclusive, royalty-free license to use, repost, and share any content created that features Bunyan Bags products for marketing purposes.
- Bunyan Bags will make reasonable efforts to credit the Ambassador when using their content.
6. Brand Guidelines
Ambassadors agree to:
- Represent Bunyan Bags in a positive and respectful manner
- Not engage in behavior that could harm the brand’s reputation
- Avoid using offensive, inappropriate, or unlawful content in connection with Bunyan Bags
7. Term & Termination
- This Agreement begins upon acceptance into the program and continues until terminated by either party.
- Either party may terminate this Agreement at any time, with or without cause.
- Upon termination, the Ambassador must discontinue use of referral links, codes, and brand assets.
8. Independent Contractor Status
The Ambassador is an independent contractor and not an employee, partner, or agent of Bunyan Bags. The Ambassador is solely responsible for any taxes or obligations arising from commissions earned.
9. Limitation of Liability
Bunyan Bags shall not be liable for any indirect, incidental, or consequential damages arising from participation in the program.
10. Modifications
Bunyan Bags reserves the right to update or modify this Agreement at any time. Continued participation in the program constitutes acceptance of any changes.
11. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction in which Bunyan Bags operates.
12. Acceptance
By applying to or participating in the Bunyan Bags Brand Ambassador Program, the Ambassador acknowledges that they have read, understood, and agree to be bound by this Agreement.
